1. Subject of the Contract
These General Terms and Conditions govern the distance purchase of accessories and equipment for Kite Surfing and Kite Racing on the website Igohigh.it. Purchases are reserved for individuals of legal age. Placing an order implies the unconditional acceptance of these terms.
2. Products and Safety (Liability Disclaimer)
2.1 New Products: All products sold on Igohigh.it are new and comply with the standards described in the product sheets. 2.2 Liability Disclaimer: Kite Surfing and Kite Racing are high-risk sports activities. The Buyer acknowledges that the use of this equipment requires technical skill and training. Ennequadro Design srl shall not be held liable for physical injury, accidents, or damages to third parties resulting from:
· Improper or negligent use of the products.
· Lack of technical experience or training by the user.
· Adverse weather conditions or the unsuitability of the practice location. 2.3 Assembly: If an accessory requires installation (e.g., lines, bridles, fins), the Buyer is responsible for correct assembly and the mandatory pre-launch check.
3. Pre-Orders
3.1 Definition: Igohigh.it may offer products for pre-order (items not yet in stock). 3.2 Timelines: Delivery dates for pre-orders are estimates provided by the manufacturers. Ennequadro Design srl is not responsible for delays caused by the supply chain but commits to a full refund if the product is not delivered within [30] days of the original estimated date.
4. Payments
Payments are processed through secure external platforms:
· NEXI: For Credit Cards, Apple Pay, and Google Pay.
· PayPal: For payments via account or card. Sensitive data is never viewed or stored on Ennequadro Design srl’s servers.
5. Shipping and Delivery
5.1 Carriers: We ship from Italy via express couriers (GLS, DHL, etc.). 5.2 Reception: Upon delivery, the user must check the integrity of the package. Any external damage must be reported immediately to the courier by signing "received with reservations."
6. Legal Guarantee and Wear & Tear (Racing Clause)
6.1 Standard Guarantee: The 24-month legal guarantee for consumers regarding original conformity defects applies (under EU law). 6.2 Limitation on Wear/Competition Use: The Buyer acknowledges that Kite Racing and intensive use accelerate the wear of materials (e.g., Dyneema lines, technical fabrics). The guarantee covers exclusively manufacturing defects evident or functional at the time of delivery or first use. The guarantee does not cover:
· Damage from impact, abrasion, or prolonged exposure to UV rays/saltwater.
· Breakage resulting from mechanical stress exceeding structural limits during competitions or extreme maneuvers.
· Normal degradation of materials due to competitive or professional use.
7. Right of Withdrawal (Returns)
7.1 Terms: The Consumer has 14 days to withdraw from the contract. 7.2 Condition of Goods: Due to safety reasons and the technical nature of the goods, the right of withdrawal is void if the
product shows signs of use, however minimal (e.g., kites inflated on a beach, wetsuits tried in water, accessories mounted and scratched). Products must be returned new, unused, and in their original, intact packaging. 7.3 Costs: Return shipping costs are the responsibility of the customer.
8. Applicable Law and Jurisdiction
The contract is governed by Italian law. For any dispute with a Consumer, the competent court is that of the user's residence; in all other cases, the exclusive jurisdiction shall be the Court of Naples, Italy
